Decree of Modification of Import Rates of Products from EU to Mexico 05/06/2018

DECREE modifying the Tariff of the General Import and Export Tax Law, the Decree establishing the Applicable Rate during 2003, of the General Import Tax, for merchandise originating in North America and the Decree establishing various Sectoral Promotion Programs .

ENRIQUE PEÑA NIETO , President of the United Mexican States, in exercise of the power conferred on me by Article 89, section I of the Political Constitution of the United Mexican States, based on articles 131 of the Constitution itself; 802, paragraph 6, of the North American Free Trade Agreement 31 and 34 of the Organic Law of the Federal Public Administration; 2nd, 4th, fraction I, 12 and 14 of the Foreign Trade Law , and
CONSIDERING
That the North American Free Trade Agreement (NAFTA) was approved by the Senate of the Republic on November 22, 1993, according to a decree published in the Official Gazette of the Federation on December 8 , 1993, which entered into force on January 1, 1994;
That the United States of America (USA) through Proclamations 9704 and 9705 of March 8, 2018, increased, as of March 23, 2018, the tariff rates applicable to the importation of steel and aluminum products to that country from around the world in 25% and 10% respectively, as a result of the adoption of a unilateral measure, justifying it under the argument of having identified imports of those products in quantities and circumstances that undermine the national security of that country;
That through Proclamations 9739 and 9740 of the President of the USA UU of April 30, 2018, that country determined to establish a temporary exemption from the payment of the increase of import tariffs on steel and aluminum products originating in Canada, Mexico and the European Union until May 31 2018;
That in accordance with the aforementioned Proclamations and the Proclamation of May 31, 2018, EE. UU determined that the aforementioned tariffs are applicable to imports of steel and aluminum products originating in Mexico as of June 1, 2018;
That regardless of the nature that the legal regime of EE. UU grant them, their measures constitute a safeguard measure in accordance with the international legal framework and, therefore, are subject to Chapter VIII: Emergency Measures of NAFTA, as well as Article XIX of the General Agreement on Tariffs and Trade and the Agreement on Safeguards contained in Annex 1A of the Multilateral Agreements on Trade in Goods of the Marrakesh Agreement Establishing the World Trade Organization (WTO), an aspect in which the international community agrees in the framework of the WTO, including some of its Members such as China, Japan, India, the European Union, Turkey and Russia;
That in accordance with the provisions of Chapter VIII: Emergency Measures of the NAFTA, EE. Before the imposition of the measures, the United States must notify the Parties without delay of the initiation of the procedure that could lead to an emergency measure, notify the Free Trade Commission, consult the affected Party , and, where appropriate. , offer compensation options in accordance with Article 802, paragraphs 4, 5 and 6 of the NAFTA;
That having failed to comply with EE. UU With the aforementioned obligations, Mexico has the right to impose measures that have commercial effects substantially equivalent to those of the measures adopted by EE. UU., In accordance with Article 802, paragraph 6 of the NAFTA;
That it is necessary and urgent to impose measures equivalent to the measures implemented by EE. UU., Under the provisions of Chapter VIII of the NAFTA and the Foreign Trade Law, consisting of the suspension of preferential tariff treatment and increase the rates of the general import tax on various goods originating in the United States. UU., Which will be valid until the Federal Executive considers that EE. UU has ceased to apply the tariff rates to steel and aluminum products originating in Mexico established in the aforementioned Proclamations 9704 and 9705;
That in order to differentiate between the goods to which the measures to be imposed will be applicable from those that will not be affected, it is necessary to create a tariff section that distinguishes pork sausages from other species;
That on December 31, 2002, the Decree establishing the Applicable Rate during 2003 of the General Import Tax for goods originating in North America was published in the Official Gazette of the Federation , and modified by the various meet in the aforementioned official dissemination body on August 17, 2005; September 12, 13 and 29, 2006; May 8 and June 30, 2007; March 18, 2009; August 18, 2010; July 7 and October 21, 2011, and June 29, 2012;
That Mexico can adjust the composition of the list of goods originating in the United States. UU to which the rates of the general import tax will be increased;
That on June 18, 2007 the Law of General Import and Export Taxes was published in the Official Gazette of the Federation , in which the Tariff Tariff applicable to the import and export of goods in national territory is established;
That through various Decrees published in the Official Gazette of the Federation on October 7, 2015, April 4, 2016, October 7, 2016, April 6, 2017 and October 17, 2017, the Tariff was modified of the Law on General Import and Export Taxes with the purpose of temporarily increasing the import tariff of 97 tariff fractions corresponding to iron and steel sector goods related to slab, sheet plate, roll plate, cold rolled sheet, plate hot rolling and wire rod, with a tariff level similar to that used by other countries;
That through this increase there has been an increase in imports from countries with which Mexico has a trade agreement and a reduction in imports from countries with which no such instrument has been concluded;
That notwithstanding the foregoing and the persistence of the absence of conditions for healthy competition between the steel industries of different countries, coupled with the unilateral measures imposed by EE. UU., A substantial increase in exports from EE supplying countries is expected. UU to our country, together with a fall in prices and a diversion of trade due to the increase in the world supply of steel that will stop consuming that country, the main importer of steel in the world;
That because of the foregoing, it is equally urgent and necessary to establish an increase of the general import tax for 186 tariff fractions of steel products, of the families of slab, sheet plate, roll plate, cold rolled sheet, rolled hot rolled sheet, wire rod, seamless tubes, welded pipes , coated sheet, rod and profiles;
That by means of the Decrees mentioned in the thirteenth recital, the Decree establishing various sectoral promotion programs was also modified , with the purpose of incorporating, for the same temporality, various tariff fractions to prevent the general import tax from impacting productive chains and competitiveness in the most sensitive industrial sectors such as electric, electronic, automotive and auto parts, so that, in order to continue congruence in the measure, it is also urgent and necessary to modify the aforementioned Decree;
That in view of the need to grant the user of foreign trade greater legal certainty for the tariff classification of goods, it is necessary to specify the description of the tariff items included in subheading 7210.49 and chapter 73 of the Tariff of the General Tax Law of Import and Export in order to avoid interpreting that a merchandise can be classified in two or more tariff fractions; It is also advisable to add explanatory notes of national application to Chapter 73, referring to tariff heading 73.04, so that the customs authority can, in a simpler and more expeditious manner, carry out the customs clearance of goods of difficult classification, such as those relating to various steel manufactures, and
That in accordance with the provisions of the Foreign Trade Law, this Decree has the favorable opinion of the Foreign Trade Commission, I have decided to issue the following

I. Modifications to the Decree establishing the Applicable Rate during 2003 of the General Import Tax , for goods originating in North America

The rate indicated in the previous table will be applicable only when they are imported definitively, including those imported under the Decree establishing various sectoral promotion programs , published in the Official Gazette of the Federation on August 2, 2002 and its subsequent modifications, as well as the Decree establishing the general import tax for the border region and the northern border strip, published in the Official Gazette of the Federation on December 24 , 2008 and its subsequent amendments.
The rate indicated in the previous table will not be applicable to the merchandise that is extracted from the national territory that was under a program of refund or deferral of tariffs in the cases foreseen in article 63-A of the Customs Law.

2. For the purposes of subheadings 7304.31, 7304.39, 7304.51 and 7304.59, the term hollow bars refers to long products of circular cross section, obtained by drilling a hole in the center of the cross section and along the entire length of a laminated or forged bar, or using a manufacturing process such as that used for seamless tubes.
They are characterized by metallurgical properties that give them machinability and lack work (beveling) at their ends. They are generally used for the manufacture of industrial parts or components for machinery (bushings, pistons, cylinders, axles, among others).
Hollow bars of these subheadings are not considered:
a) The hollow bars used for drilling, which comply with what is described in Legal Note 1, clause p) of Chapter 72. These must be classified in subheading 7228.80.   
b) Seamless pipe of the type generally used for structural, mechanical applications   
(other than machining), construction or driving.
c) With seam.

IV. General disposition.   
ARTICLE 9.- For purposes of the provisions of Article 2 of this Decree, the origin of the goods shall be determined in accordance with the Rules of Country of Origin provided in Annex I of the Agreement establishing the rules for the determination of the country of origin of the imported goods and the provisions for its certification, for non-preferential purposes, published in the Official Gazette of the Federation on August 30, 1994 and its various modifications, and must be declared in the corresponding import petition However, the foregoing, if the merchandise has any brand, label or Legend that identifies it as originating from or produced in the USA. UU shall be considered as originating in that country.
 
ARTICLE 10.- The Ministries of Finance and Public Credit and Economy, within the scope of their respective competencies, may issue general provisions that are necessary for the correct and due application of this Decree.
TRANSITORIES
FIRST.- This Decree will come into force on the day of its publication in the Official Gazette of the Federation, with the exception of the provisions of the following transitory.
SECOND.- Article 2 of this Decree, in what refers to the tariff of import of tariff fractions 0203.12.01, 0203.19.99, 0203.22.01, 0203.29.99, 0406.10.01, 0406.20.01, 0406.90.04 and 0406.90.99 will enter into force on July 5, 2018, meanwhile the tariff applicable to tariff items 0203.12.01, 0203.19.99, 0203.22.01, 0203.29.99, 0406.20.01 and 0406.90.04 will be 10% and for tariff fractions 0406.10.01 and 0406.90.99 it will be 15%.
THIRD.- Articles 3 and 8 of this Decree will expire on January 31, 2019.
